Terms of Use

1. Introduction

Thank you for visiting Jeeves Drones, Inc.’s website hosted at https://www.jeevesdrones.com ("Website" or "Site"), the mobile application (referred to as "app" or "application"), and any other affiliate websites or apps related to Jeeves Drones (collectively referred to as the "Service"). Please carefully review these Terms of Service and our Privacy Policy, as both documents require your agreement for permission to use our Service. By accessing and/or using the Service, you agree to adhere to and be bound by these Terms of Service ("Terms"). If you disagree with these Terms, you may not utilize the Service.

2. Functionality of Jeeves Drones™ and Service Limitations on Services, Weather, Cancellations, and File Storage

 

Jeeves Drones™ offers an on-demand, online checkout, and booking service for hiring photographers. Our services cater to enterprise customers seeking video services and more. Drone pilots and photographers provide the services, while an online tool delivers images, videos, and maps of worksites.

 

3. Image and Video Use Restrictions

All photos and videos provided by Jeeves Drones are strictly intended for marketing, real estate sales, or rental purposes only. These deliverables are not to be used in any legal matters, lawsuits, or similar situations without a signed agreement with the owner of Jeeves Drones. Uses beyond real estate rentals or sales are not within our scope and are restricted without direct permission.

 

If we discover that our services have been hired for legal purposes without our prior knowledge and consent, we reserve the right to refuse to complete or deliver goods or services. In such cases, we will retain a 40% fee for our time in addition to any travel fees that were due, and the remaining balance will be refunded to the client.

 

4. Liability Limitations for Drone Operations

Drone operations are subject to FAA regulations and other applicable laws. Jeeves Drones will not operate in restricted or no-fly zones and is not responsible for delays or cancellations resulting from airspace restrictions or unforeseen legal changes. The client is responsible for providing accurate information about property location and potential restrictions.

 

5. Client Responsibilities and Preparations

Clients are responsible for ensuring that properties are prepared for photography/videography services, including but not limited to cleaning, staging, and accessibility. Jeeves Drones is not liable for any delays or additional costs arising from inadequate property preparation.

 

6. Refund Policy for Cancellation Due to Regulatory or Safety Concerns

If Jeeves Drones is unable to complete a scheduled service due to regulatory, weather, safety concerns, or client-provided misinformation, we reserve the right to retain a cancellation fee equivalent to 25% of the total service cost to cover administrative expenses.

 

7. Privacy and Confidentiality for Captured Data

All captured images, videos, and data are kept confidential and will not be shared with third parties without the client's explicit consent, except as required by law. Jeeves Drones reserves the right to use non-identifiable media for marketing purposes unless expressly prohibited by the client.

 

8. File Delivery and Format Specifications

Deliverables are provided in standard file formats (e.g., JPEG, MP4). Custom formats may incur additional fees. It is the client's responsibility to ensure compatibility with their systems. Jeeves Drones is not responsible for file format incompatibility issues.

 

9. Compliance with Local Property Access Laws

Clients must ensure that property access is legally compliant and that all necessary permissions have been obtained. Jeeves Drones is not responsible for any legal disputes arising from unauthorized access to private property during service delivery.

 

10. Permits and Legal Compliance

Clients are responsible for securing any necessary permits for drone operations, including airspace, land, and specific property permits. Jeeves Drones will provide guidance on necessary permits but is not responsible for acquiring permits or for any legal penalties due to non-compliance.

 

11. Music Rights, Usage, and Liability

Jeeves Drones™ offers up to 3 song choices per video edit and cannot guarantee that music used in edited videos is or will remain royalty-free. Specific customer-requested music or genres must be provided by the customer.

Jeeves Drones uses royalty-free music from https://artlist.io/ and https://epidemicsound.com/. The licensing is limited to specific uses. This license does not cover advertising, monetized, sponsored, paid, or boosted content. It only applies to non-advertised video content. The music cannot be used in content that is resold. Licenses are valid as long as Jeeves Drones uses https://artlist.io/ and https://epidemicsound.com/ as their music provider, subject to their terms of use.

Users are responsible for ensuring they have the legal rights to use music posted online. Jeeves Drones is not liable for copyright claims, account bans, or legal actions. Users should always research artists and request permission to use copyrighted music.

 

12. Service Guarantee and Quality Control

While Jeeves Drones guarantees the quality of its services, we cannot guarantee specific outcomes or property sales as a result of our photography or videography services. The client acknowledges that the effectiveness of marketing materials depends on various factors beyond our control.

 

13. Client Cooperation and Timely Feedback

Clients are expected to cooperate fully with Jeeves Drones personnel and provide timely feedback. Delays in communication or failure to provide necessary information may impact service delivery timelines and incur additional fees.

 

14. Overtime Charges and Fees

Unless otherwise specified, any service provided by Jeeves Drones allows a maximum of 2 hours on-site. Additional time due to lack of preparation, last-minute changes, or unforeseen circumstances (excluding natural disasters, safety concerns, and weather) may incur additional fees of $199 per hour.

 

15. 3D Tour Storage, Building Scan Restrictions, and Errors

Some non-standard and large-size buildings may not scan accurately. This is especially true for buildings with very large ceilings, glass walls, or framed buildings still under construction. Clients must ensure that Matterport has the appropriate capabilities for their building before contracting our services. If Matterport does not work for a specific building, we may opt to use a service of our choice based on the needs of the client.

 

16. Image and Video Hosting

Jeeves Drones utilizes Cloud Storage and subscription services to store photos, videos, 3D tours, and other digital content. Files may be deleted after 90 days.

 

17. Matterport Storage and Deactivation

Matterport allows a maximum number of active sites at one time. Jeeves Drones monitors Zillow and reserves the right to deactivate 3D tours once a property is listed as sold, after 90 days of being on the market, or is removed from the market according to the data provided on Zillow.com. It is the responsibility of the agent to request an extension of their hosting. If a 3D tour is deactivated, there is a $30 fee to reactivate it.

 

18. Editing, Re-Edits, and Edit Requests

All edit requests must be submitted to info@jeevesdrones.com within 48 hours of delivery. Edit requests submitted later may not be available or may incur a fee of $199 per hour for time and labor.

 

19. Business Hours, Closures, and Holidays

The normal operating hours are from 8 AM to 5 PM Monday through Friday. Files are not delivered on Sundays or Government Holidays. Images delivered on these days will be delayed to the next business day.

 

20. Travel Fees and Winter Driving Fees

Travel fees are $1 per mile round trip if beyond 10 miles from Denver, or $175/hr if driving time is greater than 1 hour. Special fees may be applied for hazard driving in places like the mountains during or after snowfall.

 

21. Cancellations and Weather Policies

Unless property access is arranged, an agent or property owner must be present during the tour to provide access. Jeeves Drones is not liable for inaccessible properties and reserves the right to charge fees for cancellations, rescheduling, reshooting, and/or travel due to property inaccessibility. 22. Scheduling and Reservations

 

Appointments are booked based on availability and must be scheduled at least 24 hours in advance. Same-day or next-day requests may incur additional fees. All appointments are confirmed only when the client receives a booking confirmation email from Jeeves Drones.

 

23. Payment Terms and Conditions

All services must be paid in full before or at the time of service unless prior arrangements have been made. Invoices are due upon receipt. Late payments may incur additional fees, and services may be suspended until payment is received.

 

24. Service Modifications and Rescheduling

If clients wish to modify or reschedule a service, they must notify Jeeves Drones at least 24 hours before the scheduled appointment. Modifications or rescheduling within 24 hours may incur additional fees.

 

25. Changes to Terms of Service

Jeeves Drones reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Website. Continued use of the Service after any such changes constitutes acceptance of the new Terms.

 

26. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the state of Colorado. Any disputes arising from these Terms will be resolved through binding arbitration in Colorado. Both parties agree to waive any right to a jury trial or to participate in a class action.

 

27. Arbitration Agreement and Class Action Waiver

Any dispute or claim arising out of or relating to these Terms, including any breach thereof, shall be resolved through binding arbitration administered by an arbitrator mutually agreed upon by both parties. The arbitration will take place in Colorado, and the arbitrator's decision will be final and binding. The parties agree to resolve any disputes on an individual basis and waive any right to class or collective actions.

 

28. Indemnification

Clients agree to indemnify and hold harmless Jeeves Drones, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from the client's use of the Service, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.

 

29. Entire Agreement

These Terms constitute the entire agreement between the client and Jeeves Drones concerning the Service and supersede all prior agreements or understandings, whether written or oral.

By using Jeeves Drones' services, clients confirm that they have read, understood, and agreed to these Terms of Service.
